In January, 2006 a circuit court judge threw out a 33 year old Maryland law, that defined a marriage between a man and a woman. With both houses in democratic control, democrats have voiced a strong resistance to any type of gay ban being inserted in to Maryland's state constitution. Judge Murdock took the position that banning same-sex marriage was no less discriminatory than outlawing interracial marriage, saying that "although traditions and values are important, they cannot be given so much weight that they alone will justify a discriminatory statutory classification."
